License Agreement

Southcreek Global Media (Southcreek Digital Inc.) website is a medium for the distribution of news / press photos licensed for one time editorial use relating to events that are newsworthy or of public interest to approved editorial clients. Additional editorial usage of an image that is more then the one time license agreement will require a new separate agreement and additional license payment.

Southcreek Global Media images may contain listed restrictions of use (either on the invoice or webpage, including, without limitation, restrictions as to time, manner, industry and territory of use. Details of specific usages will be conducted with the client through a Southcreek Global Sales Representative. Use of content is strictly limited to the medium, period of time, print run, placement and size of Content and any other restrictions specified.

Images are for editorial usage only. Commercial use of images after their editorial period has expired is uniquely governed by the specific terms of the credential that the images were obtained and created under. No model releases or other releases exist on any Southcreek Global Media images unless the existence thereof is specified in writing by Southcreek Global Media.

Images from this site obtained by approved clients are not permitted to be altered or manipulated beyond normal image enhancements or cropping. Should a client violate this term Southcreek Global Media will discuss with the client the appropriate corrections required and if not obliged by the client, it may end in the clients account being suspended or closed permanently without notice at the discretion of Southcreek Global Media management and legal team.

Southcreek Global Media makes every effort to ensure the accuracy of metadata information images of all images on Southcreek Global Media’s website, clients acknowledge that Southcreek Global Media are not liable for any loss, cost or damage arising out of any misuse, inaccuracies errors or omissions in the information in any Southcreek Global Media image.

Upon client licensing of an image, Southcreek Global Media retains the full copyright and ownership of the web site and system, the photographs remain copyright of the photographer. No ownership or copyright in any Content shall pass to Licensee. You acknowledge that by purchasing an Image(s) the ownership of the image does not get transferred to you the client. You the client must not claim that it is yours and image usage to editorial inclusion in the clients own publication or those it sells in its ordinary course of business, Your license is non-transferable and legal for one time usage of the image, which means that You, the customer, are not allowed to sell, rent, give, sub license, or otherwise transfer the image or the right to use the image to anyone else. The mandatory credit line that must accompany the Southcreek Global Media image is included in each images metadata caption.
